Until December 31, 2012 the old calculation scheme allows to include the earnings for the last year. In case of choosing the old scheme, how to calculate maternity leave, a woman is obliged to write a letter to the accounting Department with a request to use the old version of the Federal law (№ 255-FZ).

With this scenario, the accounting Department determines the average daily earnings in the last year of work, taking into account all the payments that were subject to insurance contributions, with the exception of accrued vacation pay and the time travel earnings.

The order of the calculation of the next - calculated all working days, counted the sum of all paid by the employer of money from which is subtracted vacation and travel payments. Then the entire amount of the earnings should be divided by the sum of all working days. To obtain the final amount of maternity average daily earnings multiplied by the number of vacation days and maternity leave ( in the standard basis, the term is 140 days).

How to calculate maternity leave under the new scheme?

In the case of women desire to calculate maternity leave according to the new wording of the Federal law №255, the statement should not be written, as this type of calculation is done by default. In the case of the calculation of maternity benefits in new ways, the sum total earnings for the last 2 years, including vacation pay, divided by the number of days (730 calendar) and multiplied by 140 (the number of days of leave).

In addition, there is a choice of the accounting period. For example, if a woman was in holiday on care of the first baby in 2010, then she can choose the accounting period 2008-2009. This will require to write an application to the accounting.

Any calculation will be on maternity leave from 2013?

Taking into account adopted by the State Duma of amendments in the new scheme at full strength will earn since January 2013. However, the new calculation will take into account women's interests: an accounting period will be struck days of maternity leave, maternity leave, days of sick leave, leave to care for the oldest child, to care for a child with a disability, as well as the days of the liberation of women with pay (fully or partially). Thus, the period during which the worker received only limited payments, part-time salary will not be counted when calculating the average earnings.
