Standards system of labor safety

The Labor code of Russia, or rather in its tenth section, governs the employment and arising on their basis the relationship between the employee and the employer in the field of labor protection. In article 209 of this legislation, adopted in 2001, given the definition of labour protection as a system of measures, which includes legal, rehabilitation, sanitary, social, organizational, economic, technical and preventive aspects, the purpose of which is to maintain (at execution of labour obligations) of the health and life of employees of the organization. In the Soviet Union also had a system of occupational safety standards with an alphanumeric code, “GOST 12.”, which currently retains legal force on the territory of 12 countries of the CIS (all former Soviet republics except the Baltic). After the formation of independent States in the development of MGS allowed the development of national standards (for our country — it is the GOST R), which must be obligatorily harmonized relative to interstate Standards. In Soviet times there was the classifier of all standards with alphanumeric codes (most documents identified in the sections indicated the 19-th letters of the Russian alphabet). Since October 2000, it replaced the national classification of standards, constructed in accordance with the International classification ISO.

If during Soviet times, all the Standards were obligatory for application in their respective fields, law No. 184-FZ provided for mandatory technical regulations and state standards since September last year are voluntary. However, this law, as stated in paragraph 4 of article 1 does not regulate legal relations in matters concerning labour protection. Therefore, the state standards which includes the system of standards of occupational safety are among the main normative legal acts which set forth state requirements in the field of labor protection. Each of them is aimed at ensuring the guarantees enshrined in articles 7 and 37 of the Constitution.

The Whole system of health and safety standards are divided into six operating subsystems (indicated by numbers from 0 to 5) and three back-up (6 to 9). A zero subsystem includes documents of organizational-methodical character. The first consists of standards that reglamentary requirements for hazardous and harmful production factors. The second subsystem establishes safe methods and techniques for the design, construction and operation of production equipment, and the third — safety of production processes. The fourth subsystem is aimed at ensuring the safety of workers through the use of standardized remedies. The fifth includes the standards for safety of buildings and structures.

Failure to comply with any document that includes the standards system of labor safety (employer or employee) is a violation of the Labor code of our country.
