The Minsk Convention as a source of legalization

There Are cases when it is necessary to provide a number of documents in other countries or their embassies. For verification, they must undergo a special procedure called legalisation. The exceptions are documents sent to the state where the Minsk Convention.

What is legalization?

This procedure adds the document legal force on the territory of another country, which is a confirmation of the authority, the authenticity of the signature or seal of the official person who made the document.

The legalisation Procedure is divided into two types:

- affixing of the "apostille" (simplified method);

- consular legalization (for countries not signatory to the Hague).

Consular legalization – a very complex procedure, which is designed to confirm the authenticity and legality of the document sent abroad, as well as its compliance with the laws of the country.

Diplomatic or consular legalization consists of several consecutive steps:

- the document must be certified by a notary (if translation certified, you must identity the signature perevoditsea person);

- the certificate of the notary signature and seal in the Ministry of justice;

confirmation on a document stamp and signature of the authorized person of the Ministry of justice the Ministry of foreign Affairs;

- last stage – the ID of the document in the Consulate of the country in which it is directed.

Apostille in comparison with the consular legalization – very simple and straightforward procedure.

This concept originated with the signing in 1961 of the Hague Convention, which abolished the position of consular legalization. Instead of diplomatic legalization introduced a new system of certification of documents common to all participating countries, signatories of an official document in 1961, as well as for a number of States parties in the future.

In accordance with the provisions of the Convention, certification with apostille shall be subject only to official documents certified in the state bodies. With the help of this type of legalization is certified the authenticity of the signature of the civil servant who certified or issued the document, not its contents.

What is an apostille?

In most cases, it is presented in the form of a stamp, which is attached to the document or affixed directly on it. The stamp has a standard square shape, it contains the official text that indicates the country of origin of the document, attesting to the signatory and his face.

In most cases it is executed on one of the official languages, individual countries have a duplication of items contained in an apostille on one of the international languages.

Minsk Convention

In some cases, documents sent abroad do not require legalization at all. For the smooth provision of documents necessary to between the States were signed a separate agreement governing the free provision of official documents without proper assurances. For example, the Minsk Convention of 1993.

In January 1993 in the city of Minsk signed a document on legal assistance, which simplified the legalisation of foreign documents, he received the abbreviated name of «Minsk Convention”. Countries that have signed and ratified the document were the following: Armenia, Belarus, Uzbekistan, Ukraine, Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, Moldova and the Russian Federation

Thus, the Minsk Convention is a legislative act, which allows freely to work with almost all official documents issued on the territory of the former Soviet Union or in the countries of the former Soviet Union.
