From the moment of his birth every person, regardless of citizenship, nationality, race or sex, has basic rights. As they grow older and implementation of social society in the individual increases the volume of the rights, freedoms and responsibilities in relation to the surrounding society and people.

For the First time the rights and freedoms of person and citizen mentioned in the French “Declaration of rights”, adopted in the distant 1789, although the idea has a long history, the earliest mention of the fundamental privileges of the individual belong to 1215 (the year of adoption English “Carta”).

The latter document, and the most important for most countries was “universal Declaration of human rights”.

If we consider the issue in the context of a separate state, the basic rights and freedoms of man and citizen in the Russian Federation, for example, is fixed and adhered to the Constitution.

The Constitution define all the legal privileges and freedoms of the citizens of the country into separate groups that cover all the main spheres of human life:

  • Individual freedoms and rights;
  • Political;
  • Socio-economic rights;
  • Cultural.

The Personal rights and freedoms of man and citizen shall prevail.

Today this group pays special attention, as government policies aimed at the good of the people, while the Constitution of the Soviet Union, an important place was given to economic stability of the country and its guarantees.

The Personal rights belong to everyone from birth and have no attachment to nationality or citizenship, they are inalienable.

The Second Chapter of the Constitution enumerated and secured rights and freedoms of man and citizen related to his personality:

  1. The Right to life and right to protection of health implies the impossibility with impunity to deprive the life of any person. Confirmation of this norm was reflected not only in the imposition of various sanctions, but also to ban the death penalty, although it may designate as punishment in exceptional cases.
  2. Right to protection and dignity of the individual implies that no one shall be subjected to torture or another form of violence or punishment that may humiliate a person. This category can be attributed not only physical punishment, but the verbal statements in the form of libel and insult.
  3. Right to privacy implies the prohibition of unlawful deprivation of liberty or property.

The Law provides only a restriction of liberty as a sanction for the wrongful and the limitation is only possible after trial or investigation.

The Rights and freedoms of man and citizen from the earliest times are immutable value, which fought long and hard, and the people, and many of the rulers. Today, the system of rights is formed so that all the basic human values are protected under the law, there are active measures to increase funds for their strict compliance.
